3. An employer shall not hire a worker for the purpose of having him perform work referred to in section 2 unless the worker, in accordance with this Regulation, has undergone a pre-employment pulmonary health examination and holds a pulmonary health certificate.
Notwithstanding the foregoing, a worker who holds a valid pulmonary health certificate when hired is dispensed from that examination.
